1. General

The use of the National Livestock Management Database (NLMD) website (nlmd.co.uk) is subject to the following Terms and Conditions. By accepting these Terms and Conditions you agree to accept these Terms and Conditions in their entirety. NLMD reserves the right to amend these Terms and Conditions. Notification of any such amendments will be posted on the Website. These Terms and Conditions and your use of this service shall be governed by English law.

2. Legal Definitions

Agreement – These terms and conditions including the Privacy Policy
Agent – A person approved by us to be a registered user who acts on behalf of clients
Client – Someone who has been granted access to and use of the NLMD
NLMD – National Livestock Management Database
Service – The service provided by the NLMD

3. Data Protection

This policy should be read in conjunction with our Privacy Policy, which is published on the website and details our handling of all personal information supplied by you to the NLMD.

4. Licence

4.1. NLMD grants you a non-exclusive licence to access and use the content of this website for your personal use only. You may not reproduce or distribute any part of the content for commercial purposes. The data supplied by you to the NLMD belongs to you but in aggregate form belongs to the NLMD.

4.2. You agree that the copyright, database rights and all other intellectual property rights comprising in or relating to this website and the data it contains belong to the NLMD.

4.3. The NLMD may at any time make alterations to or withdraw this website or any part of it.

4.4. The Client grants NLMD a reciprocal licence to use his or her information.

5. Limitations to Liability

5.1. NLMD excludes all warranties, express or implied relating to this website (excepting warranties as described in Clause 7 below). This includes, but is not limited to, any implied warranty that the information it contains is accurate or up-to-date or is suitable for any particular purpose. The NLMD shall not be liable for any loss or damage suffered as the result of the use of this website.

5.2. Any assistance given by means of a help desk facility shall be solely at your risk.

5.3. The NLMD disclaims all responsibility and liability (including negligence) in relation to information on or accessible from this site. The NLMD accepts no liability of the quality or suitability of goods or services offered through the website (excepting Clause 7.5 below).

5.4. The NLMD shall not be liable for any delay or non-performance of the service arising from any cause beyond our reasonable control or that of our service providers.

6. Termination

6.1. The NLMD reserves the right to terminate the service immediately on notice for any material breach of any of the Terms and Conditions

6.2. The NLMD may also terminate the service without prior notice where

6.2.1. There is a regulatory or statutory change limiting NLMD’s ability to provide the service.

6.2.2. Any event occurs which is beyond reasonable control or that of any infrastructure or service provider which interferes with the NLMD’s ability to provide a service.

7. Warranty

7.1. No warranty is given as to the matters referred to in Clause 5 above.

7.2. The NLMD undertakes to use its reasonable skill and care in verifying that the data entered into the service by the user is in the correct format, that the data transmitted is the same data that the Client entered into the website (either by the user’s farm management program or directly onto the website) and that is it not corrupted by transmission. However the NLMD shall have no liability whatsoever of any losses that may occur from errors or omissions in the data entered by the user, or from the delay or failure of delivery of the service or interruptions to the service outside the control of the NLMD.

7.3. With the exception of death or personal injury caused by the user’s negligence the user will not be liable for any of the following losses which may arise by reason of any breach of the express terms in this agreement or any implied warranty condition or other term, any representation or any duty of any kind imposed on the user by operation of law or any: (a) indirect damages (b) incidental damages (c) consequential damages including (without limitation) in respect or loss of income or profits, data or use of information.

7.4. The NLMD does not warrant that the service is error free or operates without interruption or is compatible with all equipment and software configurations.

7.5. Unless death or personal injury is caused by the negligence of the NLMD, the warranties contained in clause 7.2 shall be the extent of the life of the NLMD’s liability in respect of the provision of the service and all warranties, conditions terms, undertakings and obligations implied by statute, common law custom, trade usage, course of dealing or otherwise including without limitation, all liability for negligence are hereby excluded to the fullest extent permitted by law.
